The concept of rule of law can be understood as the principle that all government processes must be governed by legal norms. It has many forms and sources, including constitutional law, statutory law, rules and regulations promulgated by administrative agencies, and federal common law. There are also several states and local jurisdictions within the United States that have their own rule of law systems.

Legal theory

Legal theory is a broad field that encompasses many different interdisciplinary approaches to law. It includes a critical and speculative component, as well as empirical questions. Legal theory books can focus on a particular controversy, question, school of thought, cultural movement, or area of legal doctrine.

Legal institutions

Legal institutions are distinct organizations which perform complementary functions prescribed by law. They are often characterized as either market-enhancing or development-enhancing.

Legal practice

The term “legal practice” has many definitions. Sometimes it is used to refer to the body of judicial precedents, administrative rules, customs, and doctrines. The term may also be used to describe legislative enactments, such as statutes and constitutions.

Legal reasoning

Legal reasoning is the process of applying rules to cases. This process is also known as deductive reasoning. The most common type of legal reasoning involves applying a rule to a specific case. A rule is a collection of facts that can be used to come to a conclusion.

Legal interpretation

Legal interpretation is the process of determining the content of legal texts. It resolves disputes and claims by determining the linguistic meaning of a provision of law. It is based on the idea that linguistic meaning constitutes the contribution to the law of a particular provision. Although it is based on the linguistic meaning of a provision, legal interpretation also seeks to determine its substantive claim.
